General terms and conditions of use of the website www.knowmadlawyer.es are established in this section. In compliance with the provisions of Spanish Law 34/2002, on Information Society Services and E-Commerce (LSSI), this legal notice is made available to website users in order to inform them of the conditions of use of the website.

We recommend that you read this Legal Notice carefully, reminding you that, if you use our website, you declare full acceptance of all the sections in force at each time you access this website.

This website under the domain www.knowmadlawyer.es is owned and managed by Eugenio J. Martín Vida, with Spanish tax number (NIF) 74643477J and professional address at c/Carles I nº 6, 07003 Palma de Mallorca, with email address info@knowmadlawyer.com (hereinafter, "KNOWMAD LAWYER").

The purpose of the website is to answer the legal questions raised by users and potential clients, to provide them with information about the activities and services offered by the website, as well as to provide information that may be interesting. The services provided through this website are performed through professionals, lawyers with the Spanish academic Law Degree and several years of professional experience.

The person in charge of the KNOWMAD LAWYER website is Eugenio J. Martín Vida, holder of University Law Degree in Spain, Lawyer number 4,589 at the Bar Association of the Balearic Islands (ICAIB), whose professional performance is governed by the Spanish Statute of Spanish Law (RD 658/2001), and by the Deontological Codes of the Spanish Law and the Law of the European Union.

The professional rules applicable to the practice of Law are contained in the General Statute of Spanish Law, approved by Royal Decree 658/2001, of June 22. (Official State Gazette No. 164 of July 10, 2001), where it can be consulted. It can also be done on the Internet on the page of the Official State Gazette (www.boe.es) and alternatively on that of the General Council of Spanish Law (www.cge.es).

The conditions set forth below regulate the permitted use of the website: www.knowmadlawyer.es.


1.- Access

With this website, KNOWMAD LAWYER, intends to provide a useful service, therefore user suggestions are welcome. If you do not agree with any of the conditions contained in this notice, you must stop using the website. Access to it implies their acceptance without reservation.

Access to this website is public. The user undertakes to make proper and lawful use of the website and its contents, in accordance with the applicable legislation, these Terms of Use, the General Terms & Conditions, the Privacy and Cookies Policies, good morals and public order.


2.- Website modifications and interruptions or access errors

KNOWMAD LAWYER reserves the right to make, at any time and without prior notice, modifications and updates on the information contained in the website, its configuration and presentation and the access conditions. Our policy is to try to keep the contents up to date.

KNOWMAD LAWYER is not responsible for any damages that may be caused by an alleged cessation or inability to use this website and its contents, loss of data or business interruption, regardless of whether or not they have been advised of such possibility.

If these mandatory data are not provided, the provision of such services will not be possible. Thus the transfer of data by the interested parties is absolutely voluntary and is duly informed by KNOWMAD LAWYER.

KNOWMAD LAWYER will process the personal data that is collected through this website, complying with the regulations of the General Data Protection Regulation and the current Spanish regulations on data protection.


Purpose

In particular, the data provided through the website will be treated for the management of the query made by the user, the contact management and the professional, administrative, accounting and tax management of the files.

Likewise, where appropriate, the personal data provided will be treated to:

• Manage the subscription to the legal blog.

• The sending of commercial advertising communications by e-mail, social networks or any other electronic or physical means, present or future, that may be of interest to the user and related to products or services offered by KNOWMAD LAWYER, as well as collaborators or partners with whom a commercial promotion agreement had been reached. Legitimacy of data processing

Personal data transmission

The data derived from the contact and the consultation made through the website will not be communicated to third parties. In the event that the contracting of a legal service provided by KNOWMAD LAWYER takes place, the personal data provided by the client may be communicated in the document and annexes attached to them that need to be prepared and sent to third parties, for compliance of the professional assignment.


Data subjects' rights

Any data subject has the right to obtain confirmation about whether KNOWMAD LAWYER treats or not personal data that concerns said data subject. Interested persons have the right to access their personal data and obtain a copy of the same. Interested persons may also update their personal data, as well as request rectification of inaccurate data, or, where appropriate, request their deletion, among others reasons, if the data is no longer necessary for the purposes for which they were collected. In certain circumstances provided for in Article 18 GDPR, interested parties may request the limitation of the processing of their data, in which case KNOWMAD LAWYER will only keep them for the exercise or defense of claims. As a consequence of the application of the right to the deletion or opposition to the processing of personal data in the online environment, interested parties have also the right 'to be forgotten' according to the jurisprudence of the Court of Justice of the EU, Interested parties may object to the processing of their data for marketing purposes, including profiling.

• Right to object the processing: KNOWMAD LAWYER will stop processing the data according to your request, unless for legitimate reasons or to carry out the assignment must continue to be treated.
• Right to data portability: in case you want your data to be processed by another firm, KNOWMAD LAWYER will facilitate the portability of your data to the new person in charge.


5.- Legal blog and comments

KNOWMAD LAWYER reserves the right to publish the comments that are sent and withdraw all those comments and contributions, that are not related to the content of the entry in which the comment is made, infringe or violate intellectual property rights,personal dignity, right to honor, own image or privacy, the right of personal data protection, are discriminatory, xenophobic, racist, pornographic, threaten youth or childhood, order or public safety or that, in our opinion, would be illegal or simply not suitable for publication. In any case, KNOWMAD LAWYER will not be responsible for the opinions expressed by users through the participation tools. Those comments not published or withdrawn will be destroyed, unless they must be kept for the exercise or defense of claims.

Whoever submits a comment is responsible for providing lawful content and undertakes to make appropriate use of the content and services offered through the website. By way of example, but not limited to the following, you agree not to use them to (i) engage in illegal activities or contrary to good faith and public order; (ii) disseminate content or propaganda of a racist, xenophobic, pornographic nature, an apology for terrorism or an attack on human rights; (iii) cause damage to the physical and logical systems to the website, its suppliers or third parties, introduce or spread computer viruses or any other physical or logical systems that are likely to cause the aforementioned damages; (iv) try to access and modify or manipulate the messages of other users.

KNOWMAD LAWYER will not be liable, in any case, for damages of any kind derived, directly or indirectly, from the failure to read this Legal Notice, or the breach of the obligations specified in the conditions established therein. Likewise, in accordance with the provisions of these conditions, KNOWMAD LAWYER excludes any liability for damages of any kind that, outside its effective control, may be due to the transmission, dissemination, storage, availability, reception, obtaining or Access to the website or its contents.

8.- Governing Law and Jurisdiction

>These Terms of Use of the website www.knowmadlawyer.es are governed by Spanish law. The governing language of writing and interpretation of this legal notice is the Spanish version. Any dispute which is not resolved in a friendly manner will be subject to the jurisdiction of the Courts of Palma de Mallorca (Spain), in case of legal entities and in the case of natural persons consumers and users to the Courts that are correspond according to the applicable regulations.

1.- Identification of the parties

On the one hand, Eugenio J. Martín Vida, with Spanish tax number (NIF) 74643477J and professional domicile at c/Carles I nº 6, 07003 Palma de Mallorca, Spain, registered lawyer number 4,589 of the Bar Association of the Balearic Islands (ICAIB), with e-mail address info@knowmadlawyer.com, owner and manager of the website www.knowmadlawyer.es (hereinafter "KNOWMAD LAWYER" or "Lawfirm").

On the other hand, the user, visitor, client or subscriber (hereinafter the "Client"), whose data are those that he has provided in the legal query form, contact form, suscription form or email (herafter "contracting form"). All the data included in the aforementioned contracting form have been entered directly by the Client, so any responsibility for their accuracy or authenticity corresponds directly and exclusively to the Client.

These Use Terms & Conditions apply to the contracting of legal services made through the contracting forms of the website, complement the provisions of the Legal Notice, Cookies Policy and Privacy Policy of the website and have been established by KNOWMAD LAWYER and accepted by the Client.


2.- Rationale

In compliance with the provisions of Law 34/2002, of 11 July, on Information Society Services and E-commerce, as well as Law 7/1998, of April 13, on General Contracting Conditions, as well as any other applicable legislation, KNOWMAD LAWYER establishes the present Terms & Conditions for the legal services offered through the contracting forms accessible through this website (hereinafter “Legal Services”).

These Use Terms & Conditions will be valid an in force while they remain published on the website, and they will refer to the service contracted at the time such conditions were available. The hiring of Legal Services implies the full and unreserved acceptance of each and every one of the present Use Terms & Conditions.


3.- Object

The object of these Use Terms & Conditions is the provision of the Legal Services by the lawyers and legal advisors of KNOWMAD LAWYER in exchange for the fees defined in each case by KNOWMAD LAWYER, which will be duly informed in advance in each case to the Client, everytime he makes a legal query through the contracting forms.

In accordance with the applicable legislation, in order to request the provision of the Legal Services, the Client must have the necessary legal capacity. It will be understood that he has said capacity by completing the form in which he requests the provision of the Legal Services. If the Client acts on behalf of a legal person, by accepting these Use Terms & Conditions he declares that he has the appropriate powers of representation and legal capacity.


4.- Language

The working language and response of the query, as well as the formalization and interpretation of this contract, will be in any case in Spanish and, at the discretion of KNOWMAD LAWYER, in any other language ​​such as English, German or Italian. If the Client wishes to contract the provision of legal services in a language other than Spanish, he must consult it beforehand.


5.- Description of Legal Services and contracting methodology

In order to contract an online Legal Service, the Client must fill in the interactive fields of the corresponding contracting form and shall formulate his legal query. In no case will documents, contracts, texts or other additional content other than those provided by the Client in the contracting form be analyzed by KNOWMAD LAWYER. The Client shall include copy of the original documentation available to him related to the legal query, as attachments to his query made through the contracting form or by email, in legible format. The Client shall also select the preferred method of communication, so that KNOWMAD LAWYER can contact the Client.

Once the request has been received from the Client, KNOWMAD LAWYER will carry out a preliminary analysis of the legal query and, in case of requiring additional documentation or information to adequately answer the Client, KNOWMAD LAWYER will inform the Client within a maximum period of 48 business hours (weekends and holidays excluded). Likewise, if KNOWMAD LAWYER does not need additional information or documentation, within the same period and after having analyzed the query and the documentation and information received from the Client, KNOWMAD LAWYER will contact the Client in order to (i) send him the estimate of fees and costs for the contracted Legal Service, indicating in the same the payment conditions (herafter the "Estimate"), as well as the expected response date the received query (herafter the "Expected response date") or (ii) to inform the Client if there is any circumstance, that does not make it possible to attend the legal query (such as conflict of interest, matter excluded from the areas of specialization of KNOWMAD LAWYER or any other reasons at the discretion of KNOWMAD LAWYER).

Unless otherwise expressly agreed by KNOWMAD LAWYER at its discretion, it will be a precondition for KNOWMAD LAWYER to answer the query made that the Client has previosly paid to KNOWMAD LAWYER (and that KNOWMAD LAWYER has received the payment in its bank account), the corresponding amount established in the payment terms defined in the Estimate. In the event that KNOWMAD LAWYER does not verify receipt of payment at least 48 business hours before the Expected response date to answer the query, the Client expressly acknowledges and accepts that KNOWMAD LAWYER will be released from the obligation to respond to said query.

If KNOWMAD LAWYER, due to unforeseen circumstances, may require a longer period of response than originally planned in the Expected response date, it will inform the Client, who will have in such case the right to accept the modification in the Expected response date or to withdraw from the contract without penalty.

The reply to the legal queries are offered and drafted by experienced lawyers or legal advisors duly registered and licensed according to the applicable legislation. However, such replies are indicative and generic based solely on the information provided by the Client in his consultation, via the contracting forms. Replies provided by KNOWMAD LAWYER do not constitute in any case specific legal advice, which can only be provided by a lawyer in view of the relevant documentation and after examining all the circumstances of the matter, not only those provided by the Client.


6.- Fees and distribution of responsibility

The fees for the legal queries will be those expressed in the Estimate provided by KNOWMAD LAWYER to the Client after having made a preliminary analysis of the information and documentation sent by the Client. The Estimate will include all applicable taxes and the amount of fees will be determined in each case by KNOWMAD LAWYER, depending on the complexity of the case and the estimated time of study and in-depth analysis of the documentation submitted by the Client.

These fees correspond only to the requested legal service, which is specified in a single payment query made by the Client and will result in a single response and a maximum of two clarifications to it, depending on the data provided by the Client. Additional legal services will not be covered by the budget sent to the Client, unless expressly indicated therein.

KNOWMAD LAWYER reserves the right to unilaterally modify at any time and without prior notice, the presentation, configuration and content of legal services, as well as their contracting conditions. Such modification will not retroactively affect the contracts already concluded.


7.- Payment method

The Client will pay the fees to KNOWMAD LAWYER by means of the payment method specified in each case on the website and/or in the Estimate sent to the Client. By default, payment will be made by bank transfer to the account indicated on the website or to the one indicated by KNOWMAD LAWYER in each Estimate.

The fraudulent use of credit cards or the refusal of the collection operation for any reason will entitle KNOWMAD LAWYER to resolve the contract of the corresponding Legal Service, without prejudice to the corresponding civil and criminal responsibilities.


8.- Billing

If the Client wishes KNOWMAD LAWYER to send the invoice for the contracted Legal Service by ordinary mail, he must expressly request it to KNOWMAD LAWYER by email or contracting form, before receiving the reply to his legal query from KNOWMAD LAWYER. Otherwise, it will be presumed that the Client prefers to receive said invoice by email in electronic format, Therefore and in accordance with the provisions of article 164. One, 3rd and Two of Law 37/1992, of December 28, Tax Law Regarding the Added Value, the Client grants his consent to KNOWMAD LAWYER to issue the corresponding invoice in electronic form to the Client, as well as to send it electronically to the mailbox provided by the Client.

Billing by email, in case of electronic invoice format, can be sent electronically signed. To that end, any of the computer programs that allow this encryption process may be used.


9.- Cancellation / Withdrawal by the Client

The Client has the right to withdraw from the contract within 14 days from the day of hiring the Legal Service, without indicating the reason and without incurring expenses on his part. Notwithstanding the foregoing, and since it is a service provision contract, this right of withdrawal will not apply once the service has been fully or substantially executed, when the execution has begun or when the Expected response date to the query is shorter to said withdrawal term and this Expected response date has been expressly known and consented by the Client. The Client declares to know and accept that, in said cases, he will lose his right to withdrawal.

In order to exercise the withdrawal right, always within the withdrawal period and under the conditions established in the previous paragraph, the Client may send written communication by contact form, email or to the professional address of KNOWMAD LAWYER, stating his decision to withdraw the contract, indicating the specific Legal Service to be canceled and providing a copy of the Client's ID.


10.- Cancellation / Withdrawal by KNOWMAD LAWYER

In the event that KNOWMAD LAWYER determines that it cannot provide the legal service requested by the Client, that the query does not correspond to any of the KNOWMAD LAWYER's areas of expertise or that the claim that the Client wants to enforce is unsustainable, KNOWMAD LAWYER may cancel the Legal Service, restoring to the Client the fees already paid for said consultation within a maximum period of 15 business days or can give the Client the option to contract the legal service with another firm or specialized lawyer, which KNOWMAD LAWYER may recommend. If due to the expiration of legal deadlines KNOWMAD LAWYER could not offer the preparation of legal responses in optimal conditions, the contracting of the legal service will be canceled without charge and the fees paid by the Client will be returned to it, unless the expiration of deadlines is due to Client's fault in providing the requested information or documentation.

KNOWMAD LAWYER reserves the right not to accept the contracting forms filled in with errors (spelling or arithmetic) or with erroneous or false data. In addition, KNOWMAD LAWYER reserves the right not to accept incomplete or fractional payments or payments made in different ways to those expressly defined by KNOWMAD LAWYER in its Estimate. In said cases, if the error cannot be easily remedied, KNOWMAD LAWYER will refund, within a maximum period of 15 business days, the amount paid except 10% for management and transfer costs.


11.- Legal deadlines

In the event that any judicial or administrative authority has granted the Client a timing to present writings, perform procedural or administrative acts, or if the Client is subject to any deadline or expiration time, the Client must request the Legal Service with enough time and due notice, informing about the existence of said deadline to KNOWMAD LAWYER. The Client expressly agrees to keep KNOWMAD LAWYER harmless from any liability, if the Client does not fulfill his communication and contracting duties referred above in due time.


12.- Validity of the contract

These Use Terms & Conditions will be deemed accepted when the Client requests the Legal Services to KNOWMAD LAWYER and the Client gives his consent to the terms included in the contracting form provided by KNOWMAD LAWYER. The Client's consent will be understood as provided by pressing the corresponding button on the contracting form or when requesting a Legal Service to KNOWMADLAWYER by sending an email through the links included on this website.

As it is an electronic contracting, the signing of this contract will be replaced by the acceptance of these Use Terms & Conditions made as set forth in the previous paragraph.


13.- Incidents and Claims

In the event that the Client wishes to report any incident or make a claim, he may do so by postal and/or electronic mail to the addresses that appear in the contact section of the website www.knowmadlawyer.com and which can also be consulted in the corresponding Legal Notice and in the present Use Terms & Conditions.


14.- Record of the contract

If the Client wishes to keep a copy of this document, he must print it at the time of contracting. KNOWMAD LAWYER will not send electronically to each Client this document or contract; however, it will be permanently available and accessible on this website.


15.- Data Protection

Some of the services included in this website require the collection of personal data that are considered essential for the provision of them by KNOWMAD LAWYER. During the data collection process, the Client will be informed of the necessary nature of the data. If these mandatory data are not provided, the provision of such services will not be possible.

The provision and processing of personal data related to this website respect the requirements of the General Data Protection Regulation and current legislation and regulations on the protection of personal data.

KNOWMAD LAWYER will treat the personal data that is collected through this website in compliance with the regulations of the General Data Protection Regulation and the current Spanish regulations on data protection. Thus the transfer of data by the interested parties is absolutely voluntary and is duly announced.

In particular, the data provided through the website will be treated for the management of the contact or the query made by the Client, and where appropriate, if there is a subsequent professional assignment, the professional, administrative, accounting and tax management of the assignment, as well as for filling purposes.

Likewise, where appropriate, the personal data provided by the Client will be treated to:

• Manage the query made by the Client.

• Manage the subscription to the legal blog.

• Sending commercial advertising communications by e-mail, social networks or any other electronic or physical means, present or future, that enables commercial communications. Said commercial communications will be related to products or services offered by KNOWMAD LAWYER, as well as by the collaborators or partners with whom a commercial promotion agreement had been reached. In this case, third parties will never have access to personal data. In any case, commercial communications will be carried out by KNOWMAD LAWYER and will be referred to products and services related to the sector and scope of the query made by the Client.

•Manage the registration to events organized by KNOWMAD LAWYER.

The legitimacy of the processing of your data is the express and informed consent you give by sending the contracting form. If the professional assignment or engagement occurs, the legitimacy of the treatment will be the contractual relationship established with KNOWMAD LAWYER and the fulfillment of the professional and legal obligations derived from it, according to the Use Terms & Conditions herein defined.

The personal data derived from the contact or the query made by the Client will not be communicated to third parties. In the event that a professional engagement or assignment occurs, the personal data provided by the Client may be communicated in the documents and annexes thereto to the Courts, Public Administrations and/or for the fulfillment of the entrusted professional assignment, as well as to attorneys, experts and other professionals who shall intervene to attend the legal query of the Client.

Rights of the data subjects

Any Client/data subject has the right to obtain confirmation about whether KNOWMAD LAWYER treats/processes or not his personal data. Data subject has the right to access its personal data and obtain a copy of the processed personal data to update them, rectification of inaccurate data or request their deletion when, among others reasons, the data is no longer necessary for the purposes for which they were collected. In certain circumstances provided for in Article 18 GDPR, the data subject may request the limitation of the processing of its data, in which case KNOWMAD LAWYER will only keep them for the exercise or defense of claims. As a consequence of the application of the right to the deletion or opposition to the processing of personal data in the online environment, the interested parties have the 'right to be forgotten' according to the jurisprudence of the EU Court of Justice. • Right to rectification (if they are incorrect) or deletion.

• Right to limitation of their treatment, in which case they will only be kept by KNOWMAD LAWYER for the exercise or defense of claims.

• Right to object to the processing: KNOWMAD LAWYER will stop processing the data in the manner you indicate, unless for legitimate reasons or the exercise or defense of possible claims must continue to be treated or processed.

The Client expressly authorizes the processing of personal data that may be collected during the provision of the Legal Service for the purpose described above and which the Client freely communicates to KNOWMAD LAWYER for such purpose. Likewise, the Client gives his consent to the communication of his data to those organs, organizations, entities or parties involved in the matters entrusted and whose refusal would render the provision of said Legal Services impossible.

The Client may, at any time, exercise, among others defined in the GDPR, the rights of Access, Rectification, Cancellation and Opposition. 16.- Professional Secrecy and Confidentiality

KNOWMAD LAWYER undertakes to treat the information to which it has access in connection with the Legal Services, in a confidential manner and subject to professional secrecy, as provided in its Privacy Policy.


17.- Validity and term

The contract will enter into force and will take effect from the moment in which the Client hires the Legal Service (when sending the query and subject to making the payment). The contract will have a defined term until the reception by the Client of the response to the contracted Legal Service.

KNOWMAD LAWYER reserves the right to terminate the contract in case of unauthorized use of the service, whether it is contrary to the provisions of these Use Terms & Conditions or any other applicable legal provision. In the event that KNOWMAD LAWYER terminates the contract for any of the reasons set forth in this clause, there will be no obligation or liability for KNOWMAD LAWYER and therefore previously paid amount will not be refunded in these cases.


18.- Conflict of Interest

In the event that two Clients agree with conflicting interests in the same matter, who had formalized a contract with KNOWMAD LAWYER, only the one who first formulates the query to KNOWMAD LAWYER. In the event that the total or partial payment of the sent Estimate has already occurred, KNOWMAD LAWYER will reimburse the amount of the consultation to the Client who has made the legal query in second place.

It will therefore be understood that there is a conflict of interest, among other cases, when a claim is raised or advice is requested against another KNOWMAD LAWYER Client, whether a natural or legal person.


19.- Liability

KNOWMAD LAWYER assumes no liability for damages, losses, claims or expenses caused by:

a. Interferences, interruptions, failures, omissions, telephone breakdowns, delays, blockages and/or disconnections in the operation of the electronic system, motivated by deficiencies, overloads and errors in telecommunications lines and networks, or for any other cause beyond its control.

b. Use of malicious programs of any kind and through any means of communication, such as computer viruses or any others.

c. Improper and/or inappropriate use of the pages and/or contents of the website.

d. Security and/or navigation errors caused by a malfunction of the browser or by the use of non-updated versions of it.

e. Directly or indirectly, for the lack of reading of these Use Terms & Conditions or for the breach of the obligations herein defined.

The Client is aware, and voluntarily accepts, that he uses this website under his own sole liability.

The Client will be liable for the damages and losses of any nature that KNOWMAD LAWYER may suffer as a result of the breach of any of the obligations to which it is subject by virtue of these Use Terms & Conditions or the applicable legislation in relation to the use of the website and unauthorized disclosure or public dissemination of the legal advice provided by KNOWMAD LAWYER.


20.- Governing Law and Jurisdiction

The parties recognize that the Spanish regulations and legislation apply to this contract, in everything not expressly provided in these Use Terms & Conditions.

Any dispute that is not resolved in a friendly manner will be subject to the jurisdiction of the Courts of Palma de Mallorca (Spain) in case of legal persons, and to the Courts determined by the applicable regulations in case of private clients or consumers.
